Terms of Service

1. Acceptance of Terms

By using Morph Fit ("the App"), you agree to these Terms of Service. If you do not agree, please do not use the App. Morph Fit is operated by Holden Spitznagle.

2. Eligibility

You must be at least 13 years old to use Morph Fit. By creating an account, you confirm that you meet this age requirement.

3. Account Responsibilities

• You are responsible for maintaining the security of your account credentials
• You must provide accurate information when creating your account
• You are responsible for all activity that occurs under your account
• You must not share your account with others

4. Subscription and Payments

• Morph Fit offers a subscription at $9.99 per month, starting with a 7-day free trial. You are not charged during the trial.
• Subscriptions are purchased on the web, not through the App Store. Checkout is hosted by RevenueCat Web Billing and payment is processed by Stripe. Your card details go to Stripe and are never stored by Morph Fit.
• Your trial converts automatically. Unless you cancel before the 7-day trial ends, your subscription begins at the end of the trial and your payment method is charged $9.99. It then renews every month at $9.99, charged at the start of each billing period, until you cancel.
• You can cancel at any time, including during the free trial, from the Subscription page in the app, from the manage link in any Morph Fit receipt email, or by emailing morphfitnessapp@gmail.com. Cancelling during the trial means you are never charged. Cancelling later stops all future renewals, and your access continues until the end of the period you have already paid for.
• Any unused portion of a free trial is forfeited when the subscription begins.
• Prices are in US dollars and may have sales tax added where it is required. If we change the price, we will tell you beforehand, and the new price applies only to renewals after that notice.
• Promotional codes may grant free or discounted access. They have no cash value, may expire or be withdrawn, and cannot be exchanged for a refund.
• If a charge looks wrong to you, email us and we will look into it and put it right where we can.
• Subscriptions bought through the Apple App Store before we moved to web billing keep renewing through Apple and are cancelled in your App Store account settings.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Upload inappropriate, offensive, or harmful content
• Harass, bully, or threaten other users
• Attempt to gain unauthorized access to the App or its systems
• Use automated tools to scrape or interact with the App
• Impersonate another person or misrepresent your identity

6. User Content

You retain ownership of content you post (workout data, photos, comments). By posting content, you grant Morph Fit a non-exclusive license to display it within the App as necessary to provide the service. We may remove content that violates these terms.

7. Fitness Disclaimer

Morph Fit is a fitness tracking tool, not a medical service. The App does not provide medical advice. Always consult a qualified healthcare professional before starting any exercise program. You use the App and perform workouts at your own risk.

8. Intellectual Property

The Morph Fit name, logo, design, and code are the property of Holden Spitznagle. You may not copy, modify, or distribute any part of the App without written permission.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You can permanently delete your account and all associated data at any time from inside the App (Profile → Edit Profile, or Settings → Privacy), or by contacting us. Upon termination, your right to use the App ceases immediately.

10. Limitation of Liability

Morph Fit is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Holden Spitznagle shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify users of significant changes through the App or by email.
